RE: Nine at Mary Brickell Village Condominium Association, Inc.

Dear Unit Owner:
We are writing to you in connection with the Association?s anticipated construction defect litigation. The purpose of this letter is to provide you with written notice that the Association requires access to your Unit to complete necessary inspections.
In that regard, please note that this is the Association?s attempt to notify you of its anticipated access to inspect your unit for construction related issues with the building.
With regard to the Association?s right of access, Section 718.111 (5)(a), Florida Statutes, provides as follows:
(a) The association has the irrevocable right of access to each unit during reasonable hours, when necessary for the maintenance, repair, or replacement of any common elements or of any portion of a unit to be maintained by the association pursuant to the declaration or as necessary to prevent damage to the common elements or to a unit.
Additionally, pursuant to Section 3.4(e) of Section 3 of the Declaration of Nine at Mary Brickell Village Condominium Association, Inc. (?Declaration?), the Association has the powers and duties as set forth in Chapter 718 of the Florida Statutes, as well as all powers and duties granted to or imposed upon it by the Declaration, including, without limitation:
?[t]he Association (and its designees, contractors, subcontractors, employees) shall have the right to have access to each Unit from time to time during reasonable hours as may be necessary for pest control purposes and for the maintenance, repair or replacement of any Common Elements or any portion of a Unit, if any, to be maintained by the Association, or at any time and by force, if necessary, to prevent damage to the Common Elements, the Association Property or to a Unit or Units??
The above quoted provisions grant the Association the right of access to your Unit.
Accordingly, please be advised that the Association and its engineer will require immediate access to your Unit to effectuate the necessary inspections.
The Association will need to access your Unit between the hours of 8:00 a.m. and 5:00 p.m. commencing on January 29, 2020 and will continue until inspections are concluded .
In the event access is impeded, the Association will have no alternative but to use the emergency key and/or engage a locksmith to access your Unit so as to avoid delay.
